In September, the NSW Government announced plans to introduce the removal of the 5km rule in Parliament in October.
ClubsNSW has been publicly advocating for the rule’s removal on behalf of members since 2022. This announcement is a huge win for the industry, as local visitors often leave venues to avoid signing up for membership, which affects club patronage.
Since the announcement, we've received some questions from member clubs, so we thought we'd break down the key details.
Has the 5km rule been removed yet?
No, not yet.
When will the Bill be introduced in Parliament?
The Bill is expected to be introduced this month.
When will the removal of the 5km rule take effect?
The Bill will outline the date the change will take effect, but it must first pass and receive royal assent.
Will clubs need to update their constitutions?
Depending on how the bill is drafted, clubs will need to review their constitutions to see if changes are needed.
Can clubs still impose a radius if they want to?
Yes, clubs will still have the option to impose a radius if they choose to (but their constitution will need to reflect this).
