Liquor & Gaming NSW (L&GNSW) has conducted several Regulatory Roadshows around the state recently, presenting on their priorities for 2024 through to 2026. A key focus will continue to be their gaming compliance blitz.

From 1 September 2023, L&GNSW will commence strict enforcement prohibiting signage that promotes the presence of gaming machines outside venues. L&GNSW’s Position Paper states: “…any sign (regardless of the words or imagery) designed to draw attention to gaming machines is captured”. Any gaming-related signage visible from outside the venue must be removed, moved or screened before this date.
L&GNSW has advised ClubsNSW that ATMs should not be seen by a patron seated at a gaming machine to minimise the chance of gaming-related harm. It may be seen as an aggravating factor if other non-compliance is identified.
Other major focuses include gaming signage, self-exclusion promotional materials, staff awareness of the club’s counselling service provider, assisting patrons with self-exclusion and ensuring promotional materials do not induce gambling.
Members should also consider the structure of their promotions to ensure gaming patrons do not receive special benefits. Promotions that prioritise gaming or do not recognise food and beverage spend, or only run late at night, are at risk of being considered an inducement to gamble. All promotions must have terms and conditions available upon request and if the value of a single promotion exceeds $10,000, a trade permit number must be applied for.
