Have Your Say on Facial Recognition and Third-Party Exclusions
In 2023, the NSW Government committed to mandating the use of Facial Recognition Technology (FRT) in clubs and hotels, and implementing a third-party exclusion scheme with gaming machines to support exclusions.
These proposals are intended to work in parallel with the introduction of the state-wide single exclusion register.
On 14 February 2025, the NSW Government released consultation papers on FRT and state-wide third-party exclusions in clubs and hotels. The consultation documents are available hereand here.
Liquor & Gaming NSW (L&GNSW) has included online surveys on the consultation pages. We encourage all members to participate in the surveys.

Consultations — What Clubs Need to Know
FRT in Clubs and Hotels
The NSW Government proposal includes:
- A draft Code of Practice for FRT to be introduced before legislation that sets voluntary minimum standards
- Requiring FRT in all clubs and hotels with gaming machines
- FRT to be used for harm minimisation and anti-money laundering
- Implementing privacy and data security measures such as consent, minimal data collection, strong passwords, Australian-based server storage and documented data deletion
- Connection to the state-wide exclusion register.

State-Wide Third-Party Exclusion
The NSW Government proposal includes:
- Allowing third-party exclusions by friends, families or venues
- Establishing a panel, convened by L&GNSW, to assess exclusion applications and provide an appeal mechanism via ILGA.
- A minimum exclusion period of 12 months.
