Hotel Hit With Fine for Allowing After Hours Gambling
On Tuesday, 8 April, a Local Court fined and convicted the licensee of Markets Hotel in Homebush West a total of $28,400 for allowing patrons to play gaming machines outside of approved hours over three consecutive weekends in July 2023.
The conviction follows an investigation by Liquor & Gaming NSW (L&GNSW) that uncovered serious breaches of gaming machine laws.
The hotel allowed 29 gaming machines to be operated between 3am and 6am on Saturday and Sunday morning, breaching the shutdown rules.
Under the Gaming Machine Act 2001, registered clubs and hotels must not operate gaming machines between 4am and 10am daily.
These restrictions are in place to limit the opportunity for continuous gaming machine play and provide a ‘break-in play’ for gaming machine players, thus limiting the risk of gambling harm.
Existing registered clubs and hotels may apply to the Independent Liquor & Gaming Authority (ILGA) to vary the shutdown period or apply for a three-hour shutdown period.

This action demonstrates that L&GNSW will act against venues operating outside of their approved trading hours.
According to L&GNSW, in November 2024 inspectors visited 138 venues across 61 local government areas in both metropolitan and regional NSW.
The operation resulted in one penalty notice and three official cautions being issued to non-compliant venues.
L&GNSW is planning more inspections in the coming months as they remain committed to holding venues accountable and minimise gambling harm.
